Regulations under Schedule 8 of Bill 10, the Measures Respecting Premises with Illegal Drug Activity Act, 2025 , have come into force on July 1, 2026.
TRREB shared concerns with the province which were considered and effective in shaping the final regulations. Following public consultation and stakeholder feedback, including TRREB, the province has determined that, when enacting these rules, the regulations will apply only to commercial landlords, thereby excluding residential landlords. Also excluded are community and supportive housing providers, retirement homes, long-term care homes, and premises providing homelessness prevention and support services, such as emergency shelters, as well as providers of health and social services.
During the government’s consultation on the proposed regulations, TRREB raised concerns about the potential impact of broad landlord liability on Ontario’s rental housing market, particularly on small-scale residential housing providers. TRREB recommended narrowly tailored regulations to avoid imposing unrealistic enforcement responsibilities on residential landlords.
We are pleased to see that the final regulations address these concerns by limiting the application of the Act’s prescribed offence provisions to commercial premises only. This provides important clarity for residential landlords and avoids additional regulatory burden.
We will continue to advocate for policies that protect community safety while supporting a stable and sustainable rental housing market in Ontario.
