TRREB recently submitted comments to the Ontario Solicitor General on proposals to regulate criminal activity on rented premises for both residential and commercial properties under the Measures Respecting Premises with Illegal Drug Activity Act, 2025.

While TRREB supports efforts to address illegal drug production and improve community safety, we emphasized that any regulatory framework must avoid imposing disproportionate liability on lawful rental housing providers. TRREB cautions that additional regulatory risk or unclear compliance obligations could discourage small-scale landlords and investors who provide a significant share of rental housing across the Greater Toronto Area.

TRREB recommends that any regulations under the Act clearly limit landlord liability to situations where landlords have actual knowledge and demonstrate willful non-compliance, rather than broad or undefined standards that could require landlords to detect criminal activity occurring within leased premises.

We will continue engaging with the provincial government to ensure community safety objectives are pursued in a way that maintains stability in Ontario’s rental housing market and supports continued investment in rental supply.
